Terms and conditions

When placing an order for buying or renting any item offered on MasterCard™'s Promotional Items Shop Site (www.mastercardshop.com) you irrevocably and unconditionally accept to be bound by and to respect these Terms and Conditions. The terms and conditions are published on the website in English, and you are invited to print and save them. MasterCard will archive the contract and you can obtain a copy of the contract.

1. Who can buy/rent an article?

Placing an order is subject to the following prior requirements:

1.1. The buyer/borrower belongs to one of the following categories:

  • A Member of MasterCard, i.e. any financial institution that is licensed to issue and/or acquire cards bearing the MasterCard brand pursuant to the MasterCard International Bylaws and Rules;
  • Any Publicity/Communication Agency ordering on behalf of a Member or on behalf of a MasterCard representative office;
  • MasterCard employees.

1.2. A correct and complete account has been created on the www.mastercardshop.com website and has been approved by Golazo Sports - Warehouse, Schoebroekstraat 8, 3583 Paal-Beringen, Belgium, MasterCard@golazo.com (VAT Number : BE0442 115 211) at her own discretion.

2. Articles available

2.1. The different types of articles offered on the www.mastercardshop.com website are divided into different categories.

This subdivision can be subject to changes, i.e. categories can be removed or added at any time and also individual products may be altered at any time, without any liability for MasterCard.

2.2. The articles are offered either for sale, either for borrowing. When an article is for sale, the price is indicated next to the specific article. When an article is for borrowing, "N/A" or "Free to borrow" may be indicated next to the specific article. An article for sale cannot be borrowed but an article for borrowing can be bought when agreed with MasterCard's Sponsorship Department. When borrowing is for free, additional costs shall be borne exclusively by the borrower, such as the costs of shipment. All insurances related to the use of this material should be contacted by the borrower.

2.3. All articles available on the Promotional Items Shop Site are described in good faith and as accurately as possible. The descriptions and offers are valid for the moment of the site consultation, or for the period mentioned on the website. MasterCard cannot be held liable for errors contained in these offers.

2.4. The articles that are presented on the Promotional Items Shop Site are on sale or for borrowing within the limits of MasterCard’s stocks availability. MasterCard is using its best efforts to make sure that the ordered articles are available. It may, however, occur that an article has run out. In such a case you will be informed within the shortest possible period and you will be able to cancel your order if you wish so, or you will receive the article(s) on a later date. MasterCard cannot be held liable for any damages stemming from the non-availability of an article.

3. Placement and Acceptance of an order

3.1. An order form placed by the buyer/borrower will contain the following information:

  • Contact details of the buyer/borrower (name, address, telephone and fax numbers, e-mail address, VAT number if any, etc).
  • Shipping address ;
  • Desired date of delivery (MasterCard, however, does not guarantee any delivery term as this depends on the shipping company);
  • VAT number.

3.2. The information provided by the buyer/borrower in the order form shall be binding on the buyer. In the event of any error in the wording, MasterCard shall not incur any liability as to the impossibility in which he may find himself of delivering the product. The price of the products remains due.

3.3. The order shall become binding upon the buyer/borrower upon confirmation thereof by the buyer/borrower by clicking on "I confirm".

3.4. The order becomes final and binding upon MasterCard only after it has been confirmed by mail sent to the buyer/borrower's email address. The confirmation goes through the system and once you click on "I confirm" an automatic e-mail is sent to the provider that keeps the ordered items (this is Golazo Sports). Any change in or cancellation of the order by the buyer/borrower can not be taken into account and the price shall be due unless you benefit from the right to withdraw from the contract as set out in article 5.5 of these Terms and Conditions.

4. Delivery of the Article(s)

4.1. The articles will be delivered to the address mentioned in the order form. MasterCard will do its best to ensure that its supplier ship articles that are in stock as soon as possible but you should take a delivery date of at least 3 days into account for deliveries in Belgium. For delivery addresses outside Belgium, the delivery dates depend on the courier. For orders related to Branding Materials, there will be a period of 5 working days between the order confirmation by MasterCard and the shipment.

For MasterCard employees, personal orders will be delivered at their office at the beginning of each month.

4.2. All articles are shipped directly by MasterCards suppliers of the article.

4.3. MasterCard is doing its best to ensure that you receive the article(s) within the timeframe specified on the Promotional Items Shop Site side but cannot be held liable for any delays in the delivery; whether they are caused by MasterCard or by the courier or the postal services.

4.4. MasterCard shall decline any responsibility for non-deliveries in the event of force majeure or in events beyond its control, which would make the performance of the agreement impossible or more expensive, in whole or in part, or in the event of actions by third parties such as the suppliers of the parties to this agreement, subcontractors, agents and representatives or in the event where the buyer/borrower fails to comply with his commitments. As cases of force majeure that release MasterCard from its obligation to deliver shall be considered, without being limited to: war, riots, fire, strikes, accidents and the impossibility of obtaining supplies. MasterCard shall keep the buyer informed about such cases or events.

In any event, the delivery within the proposed time frame shall take place only if the buyer/borrower has complied with all its obligations towards MasterCard.

5. Return Procedure

5.1. An article may only be returned in case of defect within 5 working days after you have discovered or you should have discovered the defect. A copy of the invoice or of the order form must be joined to the returned article as well as a written statement indicating the reason for the return.

5.2. Any return of an article shall be subject to a formal acceptance of MasterCard, which shall make its decision of acceptance or of rejection within 14 days from receipt of the articles. MasterCard shall be entitled to refuse the return of any articles if they are damaged or if they have been used, or if the defect does not make the article improper for its intended purpose.

5.3. An accepted return shall only allow the buyer/borrower to obtain the cost-free replacement thereof or a refund, at the discretion of MasterCard, excluding any other indemnity or claim for damages. If MasterCard accepts the return, the costs for returning the articles will be refunded to the buyer at the standard rates applied by the Belgian Post. All higher costs will be borne by the buyer.

5.4. MasterCard shall operate the exchange or the refund of products for which a defect is admitted, within a period of 14 days following its decision to accept or reject a return clause 5.2.

5.5. If you are a MasterCard employee ordering products for non-professional purposes, you will have the right to withdraw from the contract within 7 days from delivery of the product or conclusion of the service agreement, without any obligation to motivate your decision and without any cost except for the costs to return the products. Your rights will be clearly indicated in further communication with you as follows:

"De consument heeft het recht aan de verkoper mee te delen dat hij afziet van de aankoop, zonder betaling van een boete en zonder opgave van motief binnen 7 werkdagen vanaf de dag die volgt op de levering van het product of op het sluiten van de dienstenovereenkomst."

"Le consommateur a le droit de notifier au vendeur qu'il renonce à l'achat, sans pénalités et sans indication de motif, dans les 7 jours ouvrables à dater du lendemain du jour de la livraison du produit ou de la conclusion du contrat de service."

6. Return addresses

6.3. Materials that are not purchased but merely borrowed for a limited period of time must be returned, after use to :

The returned articles must arrive at Golazo Sports not later than at 4:00 P.M. on the latest date agreed upon in the borrow agreement and must be in the same condition as when the borrowing agreement started. You must insure the articles against theft, loss, fire, floods etc.

7. Payment and ‘Payment Terms’

7.1. All prices are quoted in euro, VAT not included. (VAT + environmental taxes). All taxes must be directly paid to the authorities by the buyer/borrower, except if the buyer/borrower can show that an exemption applies.

7.2. Once Golazo has sent the confirmation e-mail accepting the order, Golazo will send out an invoice for the price of purchasing or borrowing of the articles and the shipment. The customer will be informed before placing the order about the shipping costs. As the case may be, only a cost estimate can be communicated as the final price is known only once the shipment is executed.

7.3. The payment terms, as listed on the website and as printed on the back of the invoices of Golazo, will be applicable and the buyer/borrower declares to have read and accepted the payment terms before placing the order.

7.4. Payments are made by wire transfer and MasterCard only. MasterCard remains the full and exclusive owner of the articles until it receives the full payment of the articles on its account. Please note that the order will only be processed as soon as Golazo receives a PO from MasterCard or when Golazo receives a written confirmation by members.

7.5. The Golazo invoices are payable at our place of business, net, without discount, within 30 days after the invoice date, except when the invoice states otherwise. Every invoice that is still unpaid on the set due date will incur an automatic interest surcharge at a rate of 12% per annum up to the moment full payment is received, without proof of default being required, where part of a month is considered a full month, with a fixed indemnity of 10% of the invoice amount, and a minimum of EUR 60.00 per invoice. Failure to pay the invoice amount of one single invoice by the due date, renders the outstanding balance on all other invoices, even if their due date has not passed yet, automatically payable with immediate effect.

8. Limitation of liability

8.1. MasterCard does not warrant that the Promotional Items Shop Site will not suffer any interruptions or will be free of errors, nor does it warrant the accuracy or reliability of the information presented on the website.

8.2. The site is presented by MasterCard "as is". MasterCard does not provide any warranty, express or implied, related to the functioning of the site or related to the information, content, articles or links that are presented. To the extent allowed by the applicable law, MasterCard does not provide any warranty whatsoever, express or implied, including but not limited to, warranties related to the implicit commercial use and fitness for specific purpose. MasterCard cannot be held liable for any prejudice stemming from the use of its Internet site, including but not limited to, direct and indirect damages.

9. Data Protection

9.1. The buyer/borrower's personal data are processed by MasterCard Europe sprl, Chaussée de Tervuren 198A, 1410 Waterloo, Belgium, the controller of the personal data. The personal data shall be processed for the purpose of processing the order placed for buying or renting any item offered on MasterCard's Promotional Items Shop and will only be retained as long as necessary for this purpose. The buyer/borrower can request access to and/or rectification of its personal data. For these purposes the buyer/borrower can contact MasterCard@golazo.com. The buyer/borrower's personal data may, for the same purpose as stated above, also be transferred to MasterCard Europe third party contractors necessary to process the demand, such as the hosting company of this website and the bought/borrowed product providers.

9.2. For all other issues regarding the processing of personal data, the MasterCard Privacy Policy applies as it is published on this website.

10. Dispute Settlement; Submission to Jurisdiction, Governing Law.

10.1. Any dispute in any way arising out of or in connection with the interpretation or performance of these terms and conditions and/or the contract between MasterCard and the buyer/borrower, which cannot be amicably settled within fifteen (15) days of the written notice of the dispute given to the other party by exercising the best efforts and good faith of the Parties, shall be finally settled by the courts of Brussels (Belgium) in accordance with Belgian law.
